Permit to purchase real estate for foreigners.

Who it applies to

When a permit is required

The obligation to obtain a permit depends on the buyer's citizenship, the type of property, and its location. Below are the most common situations — we assess each one individually.

When a permit is required
  • Buyers from outside the European Economic Area and Switzerland
  • Purchase of a house with land
  • Purchase of building land or agricultural land
  • Property located in a border zone
  • Acquisition of shares in land following the purchase of an apartment, e.g., shares in a road, shares in access to plots with necessary infrastructure
When a permit is not needed
  • Citizens of European Economic Area and Swiss countries
  • Residential unit as a separate property outside the border zone (exception: if it is necessary to acquire shares in road plots, etc.)
  • When we purchase a cooperative ownership right to an apartment — regardless of location
  • Spouses of Polish citizens meeting statutory conditions

Can I buy an apartment without a permit?

In most cases, yes. Purchasing a standalone residential unit outside the border zone typically does not require a permit. It's different with building land or land with a house — a permit is necessary in those cases.

How long does it take to obtain a permit?

Up to 6 months.

What happens if I buy without the required permit?

A contract concluded without the required permit is invalid. That's why we always start by checking the obligation — it's the most cost-effective stage of the entire procedure.
